Federal Legal Protections

Servicemembers Civil Relief Act

The Servicemembers Civil Relief Act provides certain legal and financial protections to qualifying active-duty service members.

  • Lease termination: Qualifying service members may be able to terminate certain residential leases after entering active duty or receiving qualifying military orders.
  • Financial protections: Interest on certain qualifying pre-service debts may be limited to 6 percent during military service.
  • Eviction protection: Certain residential eviction protections may apply to qualifying service members and their dependents.
  • Judicial relief: Courts may delay certain civil proceedings or provide protections involving default judgments when military duties affect a service member’s ability to participate.

Uniformed Services Employment and Reemployment Rights Act

USERRA protects qualifying service members’ civilian employment and reemployment rights and prohibits certain forms of discrimination based on military service or obligations.

These protections may include reemployment rights, continuation of certain benefits, and protection from discrimination or retaliation. Eligibility and requirements depend on the circumstances of the military service and employment.
