Federal Claims
Federal claims are paid through the United States Government for property damage, personal injury or death caused by a negligent act or omission of an employee of the United States acting within the scope of employment.

State Claims
State claims are claims for property damage, personal injury or death proximately caused by the wrongful act or omission or the negligence of an employee acting within his scope of employment if arising from the operation or use of a motor-driven vehicle or motor-driven equipment and the employee would be personally liable to the claimant according to Texas law.
